Plant Devas Inc. dba evanhealy (“Company”, “us”, “we”, or “our”) operates the http://www.evanhealy.com/ website and any of its subpages (the “Site”).

This page informs you of our policies regarding the collection, use, and disclosure of Personal Information (as defined below) when you use our Site and the services we offer through the Site (collectively, the “Services”).

By using the Services, you agree to the collection and use of your Personal Information in accordance with this policy. Unless otherwise defined in this Privacy Policy, terms used in this Privacy Policy which are not otherwise defined in this Privacy Policy will have the same meaning as in our Terms of Use, accessible at: https://www.evanhealy.com/pages/terms-of-use.

  1. What Personal Information We Collect. For you to access Services that we offer, Company may collect information that identifies, relates to, describes, or could reasonably be linked, directly or indirectly, with you (“Personal Information”). The Personal Information we may collect from you include without limitation:
  • Identifiers – For example, your first and last name, alias, account name, online identifier, Internet Protocol Address, social media account name, email address, postal address, phone number, or other similar identifiers. Our web servers automatically collect unique identifiers that can be used to recognize you or your device, including without limitation your domain name, beacons, pixel tags, or other device and mobile identifiers or similar technology.  
  • Characteristics of Protected Classifications Under California or U.S. Law – For example, your age, gender, marital status, and pro-noun preference.
  • Payment Data – For example, your credit card information, billing address, or any financial information you provide in connection to your use of our Services and purchase of our products.
  • Commercial Information – For example, our products you purchased, obtained, or considered, our loyalty programs, promotions, sweepstakes, and contests that you participated in, and other and your information regarding your purchasing or consuming history or tendencies.
  • Internet or Other Electronic Network Activity Information – For example, your browsing history, search history, and any other information regarding your interaction with our Site, Services, advertisements, or third-party applications.
  • Geolocation Data – For example, information the country you reside in and any information that can help identify your physical location like your GPS coordinates or the approximate location of your electronic devices (e.g., IP address or zip code). We may also collect precise information about your location.
  • Audio and Visual Information – For example, recordings of your voice when you call customer service, voice recordings when you leave voicemails on our voice mail boxes, image recordings of you if you attend one of our promotional and marketing events, and photos or images of you if you choose to send us a pictures of you.
  • Professional or Employment-Related Information – For example, your employer, title, and other work-related information you provide to us if you apply for a job through links to our Site or choose to voluntary provide such information to us.
  • Non-Public Education Information – For example, school(s) you attended, grades, transcripts, and other information relating to your secondary and post-secondary education, including any graduate or professional degrees.
  • Physical Characteristics – For example, including skin tone and type and other beauty profile information you provide.
  • Health and Medical Information - Including information you choose to provide regarding skin conditions or medications in connection with a beauty service, in-store digital experience, or through your consultation with our estheticians.
  • User-Generated Content – For example, product testimonials, ratings, reviews, tracking information, chat content, social media profiles, photographs, images, videos, survey responses, comments, and other content you provide us.
  • Sensitive Personal Information – For example, the content from messages, testimonials and comments you send us, your account log-in, financial account, debit card, or credit card number in combination with any required security or access code, password, or credentials allowing access to an account, precise geolocation information and any information regarding your skin health.
  • Other Categories of Personal Information that Relates to or is Reasonably Capable of Being Associated With You - For example, information we collect from you if you interact with social media websites, networks, chat features or other services that host user-generated content (e.g., your comments to our Instagram or Facebook posts or when you tag or otherwise link us in your social media posts).
  • Data About Others – For example, Personal Information of individuals for whom you purchase an item or gift, such as their first and last name, email address, phone number, and postal address. Please do not share Personal Information of other individuals with us unless you have their permission to do so.
  1. How We Collect Your Personal Information. We collect Personal Information about you from various sources, including without limitation information which you provide us directly, information we collect automatically from you through cookies, information we collect from third parties such as our service providers and vendors, and information from public forums, social media platforms and other networks. We may also collect your Personal Information from third parties.  Some specific ways we collect Personal Information include, without limitation, when you:
  • Browse our website (i.e., through our browser cookies, web beacons, third party software, and other similar technology).
  • Create an account on our website.
  • Sign up for our Truth Seeker Newsletters or loyalty activity programs.
  • Schedule a free virtual consultation with an esthetician.
  • Downloading our skin guides or other informational materials.
  • Purchase or return our products or sign up or cancel a subscription of products.
  • Utilize our chat feature or submit an inquiry or comment through our Site or platform.
  • Voluntarily complete a survey or send us messages or other content regarding our Service, products, marketing material, and other advertisement and collaboration proposals.
  • Voluntarily disclose Personal Information to us or our service providers.
  • Leave a review, comment, or provide any type of content on our Site, Services or social media posts hosted by third-party platforms.
  • Tag or otherwise link us on your social media posts.
  • Conduct searches for local spa estheticians or stores selling our Products.
  • Apply for a job with us through our Site or service provider.
  • Interact with other third parties (e.g., our service providers) and provide your consent for them to share your Personal Information with us.
  1. How We Use Your Personal Information. We collect and use your Personal Information for various business and commercial purposes, including without limitation:
  • Sending you alerts regarding our Site, Service, products, and business that we think may interest you.
  • Operating, managing, and improving our Site, Service, products, customer outreach, advertisements, events, and promotions.
  • Communicating with you through telephone, email, chatbox through features of our Site, live video conference, and social media or message platforms.
  • Executing our advertising and marketing campaigns.
  • Performing services requested by you, such as processing, servicing, or enforcing transactions, and sending you related communications.
  • Responding to your inquiries, product requests, and feedback.
  • Conduct research and analytics and create aggregated, pseudonymized, or anonymized information for statistical purposes.
  • Analyzing trends and usage, such as the efficiency of deliveries and operations
  • Maintaining the security and integrity of our Service, systems, operations, and products.
  • Preventing and addressing fraud, unlawful access, and breach of our policies and terms.
  • Sending you technical notices, updates, security alerts, information about our policy changes, and other administrative messages.
  • Helping to establish and verify the identity of users and complying with all applicable laws and regulations.
  • Pursuing legal matters.
  • Providing you with advice and recommendations regarding skin care and skin products to try.
  • Troubleshooting problems with our Site, Service, software, or other technology resources.
  • Facilitating our accounting, auditing, and reporting requirements and processes.
  • Re-posting content that you voluntarily provided us through our Services or social media networks, platforms, or other user-generated content providers not operated by Company for our marketing purposes.
  • Creating promotional videos or other marketing materials from pictures, images, drawings, audio, videos, testimonials, or other content you may submit or share with us.
  • Conduct, host or participate in online and offline events.
  • Facilitate our internal business operations, including compliance with our professional obligations.
  • Fulfilling any other business or commercial purposes at your direction or with your consent.
  1. Who We Share Your Personal Information With. We may disclose information we collect about you with other third parties, including without limitation:
  • Service Providers - We share information with third parties that help us maintain and operate our Service, analyze data, create, and execute advertisements, conduct outreach, and support our general business. Our third-party service providers may only use shared information to perform specific services that we have contracted them for and may not use it for any other purpose, although we may permit them to use aggregated information which does not identify you or de-identified data for any purpose except as prohibited by applicable law. For example, we engaged hCaptcha to operate our chat features on our Site and when you use such chat features, the contents of your chat are shared and processed by hCaptcha. Additionally, we engage professional estheticians to perform live skin consultations with you and may share with them any photos or information you provide to us so the estheticians can prepare for the call.
  • Vendors - We may share information with vendors and other third parties in connection with: tailoring and distributing targeted advertisements; measuring and improving our Service, products, and advertisements; processing your orders; and helping us execute our business objectives. These vendors and other third parties may function as our service providers, or in certain contexts, independently decide how to process your information.
  • Affiliates - We may share information with our related entities including without limitation our parent, subsidiaries, and sister companies, or to their employees, agents, contractors, representatives, legal counsel, and/or accountants, for: operational, management and administrative purposes; internal audit, legal, regulatory, security, insurance, financial, and other similar purposes; or as otherwise permitted by law.
  • Promotional Partners - If you voluntarily subscribe to our Truth Seeker Newsletters, we may share your Personal Information to help us provide and operate our newsletter offerings. This includes without limitation sharing your information with our service providers that maintain our newsletters, our third-party partners (if applicable) participating in our promotions featured on our newsletter, or other third parties for administrative purposes.
  • Professional Advisers – We may disclose your Personal Information with our professional advisers, insurance brokers, and agents to administer our relationship with you or to facilitate our internal business operations.
  • Social Networks – We may obtain your information from a social media platform if you interact with us on our social media accounts, platforms and networks and may share any posts or content that you have tagged us on or relate to our products and services in our own social media accounts and websites.
  • The Public and Public Forums – Our Site may provide the opportunity to post content in a public forum. For example, our Site allows users to provide reviews and ratings of our products. If you decide to submit information in these public forums, that information will be publicly available.
  • Third Parties in Connection with a Merger, Acquisition or Other Business Transaction - We may share information if Company is involved in a merger, acquisition, sale of all or a portion of its assets, financing, joint venture, reorganization, dissolution, liquidation, or other event where we sell or transfer all or a portion of our business assets or equity. We will not provide you with notice before disclosure in such cases. 
  • Third Parties for Security and Compelling Disclosure Purposes – We may disclose your Personal Information in response to lawful requests by public authorities and to meet national security or law enforcement requirements. We may share your Personal Information in connection with legal requirements, such as in response to an authorized subpoena or when we believe in good faith that disclosure is necessary to protect our rights, to protect your safety or the safety of others, or to investigate fraud. Such disclosures may be conducted without notice to you.
  • Third Parties that You Direct Us to Share With - We may share your Personal Information at your request or direction, such as when you purchase a gift for an individual and direct us to notify the recipient of who purchased the gift. We may also share your Personal Information with those that you have consented or directed us to share your information with.
  1. Privacy Policies of Third Parties and External Links. Our Services contain links to several third-party websites, software, or applications not owned or controlled by Company, and this Privacy Policy does not apply to such websites, software, or applications or the use of any data by such websites, software, or applications.  Should you decide to navigate to any websites, software, or application or webpages external to our websites, you do so entirely at your own risk. We are not responsible for the actions, privacy, security, or content of such third-party websites, software, and applications.  If you are asked to provide information on one of these websites, software, and applications, we encourage you to carefully review their privacy policy before sharing your information.

Company and its preferred third-party service providers or business partners may offer sweepstakes, contests, promotions and surveys (each, a “Promotion”).  Where we do this, we will use your Personal Information as set out in this Privacy Policy, or as otherwise notified to you. However, in certain cases, a third party’s privacy policy may apply to any Personal Information that you provide in connection with such Promotion. Before entering any Promotion, we encourage you to check who is operating the Promotion in question, and the terms, conditions, policies, and rules that apply to it.

  1. Cookies and Other Similar Technology. Like many online retailers, we and our third-party partners and service providers (such as advertising networks, analytics providers and social media platforms and networks) may collect certain Personal Information and aggregated non-personally identifiable information about you when you visit our Site with cookies, pixels, web beacons, and other tracking technologies.

Cookies are text files placed on your computer to collect standard Internet log information and visitor behavior information. The types of cookies we use are:

  • Strictly necessary cookies. These are cookies that are required for the operation of our Sites, such as cookies that enable you to log into your account or make purchases, or cookies that enable us to comply with the law (for example, to keep your information safe). We would not be able to operate our Sites without using “strictly necessary” cookies.
  • Performance cookies. These cookies recognize and count the number of users to our Sites and help us see how users move around our Sites. These cookies do not collect information that personally identifies a visitor. We only use such information to improve our Sites. This information helps us to find out how well our Sites are working and highlights where it can be improved.
  • Functionality cookies. These cookies are used to recognize when you return to our Sites and assist us to personalize your content and Site experience by remembering your preferences.
  • Targeting cookies. These cookies record your visit to our Sites, the pages you have visited and the links you have followed. These types of cookies are used by operators of third-party advertising networks to advertise relevant products to you on the internet, based on the products and categories you looked at or purchased on our website. As further set forth in the section entitled “BEHAVIORAL REMARKETING” below our website currently uses tracking pixels with third parties such as Google and Facebook for marketing and remarketing purposes. This technology allows us and our third parties to collect information when you access our Sites, including without limitation the products on our Sites you have viewed, whether you have made a purchase and, if you make a purchase, the details of the transaction including products bought and amount of the sale. The third-party providers can identify specific users of their platforms through the ID number used in their tracking pixels. This information allows those providers to tailor what marketing material you are shown through those platforms and when browsing the internet. We also receive aggregated reports from those third parties in relation to our advertising campaigns, including de-identified information about the number of users who were shown our advertising campaigns and subsequently purchased our products. These reports use aggregated information and do not allow us to identify specific individuals from those transactions.
  • Social media cookies: These cookies are set by a range of social media services that we have added to our Sites to enable you to share our content with your friends and networks. They can track your browser across other sites and building up a profile of your interests. This may impact the content and messages you see on other websites you visit. If you do not allow these cookies, you may not be able to use or see these sharing tools.

We may use cookies in a range of ways to improve your experience on our Sites, including without limitation to:

  • Report, in aggregate, how our visitors find and use our websites;
  • Understand overall visitor behavior;
  • Update and improve our websites and application; and
  • Process your orders and other requests.

We may also use cookies to recognize your information across different devices that you use or log in from (e.g., computers or mobile devices).  We may recognize that one cookie ID (e.g., from a computer) may be connected to another device (e.g., smart phone) by the device ID or log in. This may result in you searching for one of our products on one device but seeing an advertisement later for that product on another device. By knowing what devices are being used by a person or household, we can limit the number of times you may see the same advertisement across different devices.

We may also use pixels and web beacons. Pixels and web beacons are a type of code that are embedded in a website, video, email, or advertisement that sends information about your use to a server. There are several types of pixels, including image pixels (which are small graphic images) and JavaScript pixels (which contains JavaScript code). When you access a website, video, email, or advertisement that contains a pixel, the pixel may permit us or a separate entity to drop or read cookies on your browser. Pixels are used in combination with cookies to track activity by a particular browser on a particular device. We may incorporate pixels from separate entities that allow us to track your communications with us, bring you advertising both on and off the Sites, and provide you with additional functionality, such as the ability to connect our Sites with your social media account.

By setting your email account to display emails as text only, you may be able to prevent the use of some pixels and web beacons, however, please be aware that our emails won’t look as pretty and some functionality may be disabled. Alternatively, you can remove yourself completely from our mailing list by going to the bottom of any email from us and clicking on the relevant 'unsubscribe' link in the emails.

  1. Behavioral Remarketing. We may partner with third parties to assist us in the overall performance and advertisement of our Site, products and/or Services, and such third parties may place cookies or other online tracking technologies on our Site in connection with our agreement with them. Specifically, we utilize remarketing services to provide you with targeted advertisement after you visited our Site. We, and our third-party vendors, use cookies to inform, optimize and serve ads based on your past visits to our Site.  Some examples include:
  • Google - We use Google Analytics and Google AdWords remarketing service as provided by Google Inc. Google uses cookies and tracking pixels to among other things, help us to analyze how users use the Sites, gather reports on our Sites’ activity, and provide other services relating to our Sites’ activity.  It also allows us to track IP address, geo-location, operating system, type of device (mobile or desktop), type of browser or mail program used, user behavior on a website, social network, time the website was visited, website traffic, and sales conversions. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google’s behalf.

  1. Security and Storage. We believe our Services incorporates safeguards to protect the security, integrity, completeness, accuracy, and privacy of the Personal Information we have collected.  We have put in place reasonable precautions to protect information from loss, misuse, and alteration.  However, despite our efforts, please be aware that no security measures are perfect or impenetrable and we cannot guarantee that the information you transmit or provide to us will be completely secure. 

We will retain your Personal Information for as long as needed to provide you with our Services and products (e.g., as long as you have an online account with us) or as needed to fulfill our own obligations, such as preventing fraud, meeting regulatory requirements, resolving disputes, improving our services or maintaining security, and in each case, as consistent with applicable law.  We may retain non-Personal Information that has been sufficiently aggregated or anonymized for a longer period.

  1. Children. Our Site is intended for general audiences and are not directed to children under 18.  We do not knowingly collect Personal Information from children under 18.  If you become aware that a child has provided us with Personal Information without parental consent, please contact us at [email protected]. If we become aware that a child under 18 has provided us with Personal Information without parental consent, we will take reasonable steps to remove such information and terminate the child’s account (if applicable).
  2. Your Choices You Have Over How Your Information is Used. In this section, we describe the rights and choices available to all users.
  • Review and Update Your Account Information - If you registered for an account with us, you may review, update, or delete certain Personal Information in your account by logging into your account and editing your profile information.
  • Opt Out of Marketing Communications -You may opt out of our newsletters and marketing-related emails by following the opt-out or unsubscribe instructions located at the bottom of our emails.  You may continue to receive service-related and other non-marketing emails (e.g., confirmation emails regarding your online orders). 
  • Cookies – As noted above, most browsers let you remove and/or stop accepting cookies from the websites you visit.  To do this, follow the instructions in your browser’s settings. Note that disabling cookies and/or other tracking tools may prevent Company or its service providers from providing you certain features of our websites.
  • Advertising Choices - Your device settings may provide functionality to limit use of advertising ID associated with your device for interest-based advertising purposes. Additionally, you can manage third-party advertising preferences for some of the third parties we work with as further discussed in the section entitled “Behavioral Remarketing.” 
  • Choosing Not to Share Your Personal Information – You may elect not to share certain Personal Information to us. If you do not provide certain Personal Information that we need to provide you with our Services and products, we may not be able to provide you with our products or other services or provide you access to certain features of our Service.  For example, if you do not provide us with your payment information then we will not be able to process your orders for products.
  • Third Party Platforms or Social Media Networks - We encourage you to review your privacy options and settings of third-party platforms that you use in connection with our Service, including without limitation social media platforms and networks. We recommend you understand what choices you have about sharing information from those platforms and networks with us.
  1. California Residents: Direct Marketing and Do Not Track Signals - Under California’s “Shine the Light” law, California residents may request and obtain a notice once a year about certain Personal Information we shared with other businesses for their own direct marketing purposes. Such a notice will include a list of the categories of certain Personal Information that were shared (if any) and the names and addresses of all third parties with which the Personal Information was shared (if any). The notice will cover the preceding calendar year. To obtain such a notice, please contact us as described below. In addition, under this law you are entitled to be advised how we handle “Do Not Track” browser signals. Company does not take any action in response to Do Not Track (DNT) signals.   2. Canadian Residents: Your Canadian Privacy Rights. If you are in Canada and certain requirements are fulfilled, you may have the following data protection rights regarding your Personal Information. For purposes of this Section, “Personal Information” shall have the meaning ascribed to it under the Personal Information Protection and Electronic Documents Act (“PIPEDA”).
  • Right to Access – You have the right to request access to information relating to the existence, use, and disclosure of your Personal Information. We will respond to an access request within a reasonable time frame and no later than 30 days from receipt. 
  • Right to Correction – You have the right to request we correct inaccurate or incomplete records of Personal Information that we hold about you. Such corrected information will be passed downstream to any third parties with whom we shared your inaccurate or incomplete Personal Information with.  
  • Right to Withdraw Consent – You have the right to withdraw consent at any time, however, we may retain Personal Information for the period in which it is necessary to fulfill the purpose for which it was collected.  
  • Right to Erasure – The Office of the Privacy Commissioner of Canada (“OPC”) has taken the position that individuals should have the ability to remove information that they have posted online. It is suggested that PIPEDA currently includes this right in relation to the right to withdraw consent.

You also have the right to file a complaint with the OPC if you believe we are in violation of PIPEDA. We would, however, appreciate the opportunity to address your concerns before you approach the OPC, and would welcome you directing an inquiry first to us by contacting us via the methods set forth in the section entitled “HOW TO CONTACT US.”

 

  1. European Economic Area and United Kingdom (“EEA”) Residents: Your EEA Privacy Rights. Data protection laws in Europe and the United Kingdom require a “lawful basis” for processing “personal data” (as defined by GDPR). Our legal basis to process your personal data, includes without limitation:
  • Necessity – We will process your personal data as necessary to perform our responsibilities under our contact with you (e.g., processing your order and delivering the products you purchase);
  • Legitimate Interest – We will process your personal data when we have a legitimate interest in processing your personal data and these interests are not overridden by your rights and interests (e.g., communicating with you regarding changes to our Programs or Privacy Policy);
  • Consent – If you provide us with your consent to perform a specific processing activity, we will process your personal data to perform such activity (e.g., sending you marketing emails); and
  • Legal Obligation – In some cases, we will process your personal data as necessary for compliance with our legal obligations (e.g., responding to a court order).

  • Right to Rectification - You have the right to request that we correct any information you believe is inaccurate. You also have the right to request we complete information you believe is incomplete.
  • Right to Erasure - You have the right to request that we erase your personal data, under certain conditions.
  • Right to Restrict Processing - You have the right to request that we restrict the processing of your personal data, under certain conditions.
  • Right to Object to Processing - You have the right to object to our processing of your personal data, under certain conditions.
  • Right to Data Portability - You have the right to request that we transfer the data that we have collected to another organization, or directly to you, under certain conditions.
  • Right to Withdraw Consent - You also have the right to withdraw your consent at any time where we relied on your consent to process your personal data.

You may exercise any of the above rights by contacting us via the methods listed under the section entitled “HOW TO CONTACT US” below. We will have one month to respond to you.  Please note that we may ask you to verify your identity before responding to such requests.

You also have the right to file a complaint regarding your Personal Information with a data protection authority if you believe that the use or handling of your Personal Information does not comply with legal requirements. We would, however, appreciate the opportunity to address your concerns before you approach a data protection authority, and would welcome you directing an inquiry first to us by contacting us via the methods set forth in the section entitled “HOW TO CONTACT US.”

 

  1. Geographic Restrictions. We may limit the availability of our Services to any person or geographic area at any time. If you access our Services from outside the United States, you do so at your own risk.
